Module Annotation

The International Business Law module offers LL.M. students an introduction to selected topics in public and private international law. The aim of the course is to acquaint students with the key legal principles and frameworks that govern international business transactions and dispute resolution. Lectures will present the core concepts of each module and serve as a structured guide. During consultations, students will analyze real-world issues through hypothetical cases and established case law, fostering critical thinking and practical application.

Upon successful completion of the module, students will be able to critically evaluate legal cases, distinguish between questions of fact and questions of law, navigate relevant sources of law, and clearly formulate and defend their opinions in the context of international business.

 

Course Objectives and Methodology

Upon completion of the module, students should be able to:

  • Critically assess and analyze cases in international law.
  • Distinguish between factual and legal issues.
  • Identify and apply relevant sources of international law.
  • Develop and defend well-reasoned legal arguments.

The course combines lectures, case studies, and consultations with practical exercises, enabling students to apply legal theory to real-world situations.

 

Course Focus and Modules

  1. Settlement of Disputes in International Law – Jurisdictional issues; the role and functioning of the International Court of Justice; arbitration courts; municipal courts and their interaction with international law.
  2. International Investment Law – State immunities; types of investment treaties and standards of protection: minimum standard, fair and equitable treatment, most-favoured-nation principle, full protection and security.
  3. Conflict of Laws – Renvoi; the issue of characterization; jurisdiction over contractual and tortious claims under EU regulations; determination of the applicable law.
  4. United Nations Convention on Contracts for the International Sale of Goods (CISG) – Scope of application; contractual obligations; breaches and remedies for buyers and sellers.
